IMPORTANT NOTICE – NO FIREARM SALES
Winner Defense Group Inc (“Winner Defense Group,” “we,” “our,” or “us”) is a Texas-based retailer and distributor of firearm parts, accessories, and related equipment. We DO NOT sell complete firearms, frames, receivers, or any other serialized items that are regulated as “firearms” under federal law.
Nothing on our website or in this policy should be interpreted as an offer to sell a firearm. All products offered by Winner Defense Group are non-serialized parts, accessories, or related gear.
CUSTOMER RESPONSIBILITY FOR COMPLIANCE
You are solely responsible for knowing, understanding, and complying with all federal, state, and local laws, regulations, and ordinances that apply to the purchase, possession, use, and shipment of any product you order from Winner Defense Group. By placing an order, you represent and warrant that you are legally permitted to purchase and possess the items you are ordering in your jurisdiction.
If we determine, in our sole discretion, that an order appears to violate or may violate any applicable law or regulation, we may cancel the order and issue a refund subject to any applicable restocking or processing fees as stated in this policy.
NO INTERNATIONAL SHIPPING
We do NOT ship internationally. All orders must ship to addresses within the United States and its territories where permitted by law.
SHIPPING POLICY
Order Processing & Shipping Time
Winner Defense Group Inc usually ships in-stock orders within three (3) to seven (7) business days after successful payment authorization. We ship orders Monday through Friday, excluding federal holidays. Orders placed on Fridays, weekends, or holidays may not begin processing until the next business day.
We make reasonable efforts to process and ship orders promptly, but shipping and processing times are estimates only and are not guarantees. We are not liable for delays caused by carriers, weather, acts of God, supply chain disruptions, or other events beyond our control.
Carriers & Methods
Our primary shipping providers are USPS, UPS, and FedEx. We reserve the right to choose the most appropriate carrier and shipping method for your order, regardless of the method selected at checkout, so long as the chosen method is reasonably comparable.
All shipments include tracking numbers. A tracking number will be emailed to you when the order is shipped, using the email address provided at checkout.
Insurance & Signature Requirements
- Orders with a merchandise value under $50.00 are insured by Winner Defense Group at our discretion.
- Orders with a merchandise value of $50.00 or more require insurance, and the cost may be included in your shipping charge.
- Depending on the value and nature of the products being shipped, an adult signature (21 years of age or older) may be required upon delivery. We reserve the right to require a signature on any shipment, in our sole discretion.
Address Restrictions & Undeliverable Addresses
Not all methods are available to all addresses. We may be unable to ship to certain addresses due to carrier limitations, local regulations, or our internal risk controls. If the shipping method you have selected is not available to your address, we will contact you to arrange an alternative method or cancel the order.
Risk of Loss
Risk of loss and title to the products pass to you when we deliver the products to the carrier. Once the carrier accepts the shipment, we are not responsible for loss, theft, damage, or misdelivery, except to the limited extent provided under the “Missing Packages” section and any applicable carrier insurance policy.
Restricted Jurisdictions & Order Refusals
Winner Defense Group Inc reserves the right at any time to:
- Review federal, state, and local regulations for any shipping destination;
- Refuse shipment to any jurisdiction or address; and/or
- Cancel and refund any order that we believe, in our sole discretion, may violate applicable law, pose unreasonable risk, or be inconsistent with our internal policies.
If we cancel an order due to legal restrictions or compliance concerns after you have placed it, we may refund your payment minus up to a fifty percent (50%) restocking and processing fee to cover administrative, handling, and merchant processing costs associated with your order.
PRODUCT TYPES & FFL SHIPMENTS
Winner Defense Group Inc does not sell or ship complete firearms, frames, or receivers. Occasionally, certain products (for example, highly regulated accessories or items subject to manufacturer policy) may be required to ship only to a Federal Firearms Licensee (“FFL”). If a product is designated as FFL-only on the product page, you will be required to provide valid FFL information, and shipment will only be made to that FFL.
If you fail to provide valid FFL information when required, your order may be cancelled and refunded subject to the restocking and processing fees set forth in this policy.
MULTIPLE PRODUCT ORDERS
For multiple product orders, we will make every reasonable attempt to ship all items in that order at the same time. Products that are unavailable at the time of shipping may be shipped as they become available, unless we inform you otherwise.
You will only be charged for products contained in each shipment, plus applicable shipping charges. You will only be charged for shipping at the rate quoted at the time of purchase, and the full shipping charge is normally applied to the first shipment on a multiple-shipment order.
WARRANTY POLICY
Relationship to War Hammer Armaments; No Independent Winner Defense Warranty
Winner Defense Group is an independent retailer and distributor. All products we sell are manufactured solely by War Hammer Armaments (“WHA”). Winner Defense Group does not design or manufacture any products and does not provide any separate or additional warranty beyond the applicable WHA manufacturer’s warranty.
To the fullest extent permitted by law, all products are sold by Winner Defense Group “as is” and “with all faults,” subject only to the limited warranties, if any, that WHA itself provides for its products. Winner Defense Group expressly disclaims all implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent allowed by applicable law. If implied warranties may not be disclaimed in your jurisdiction, such warranties are limited in duration to the term of the applicable WHA limited warranty.
In all cases, the current written warranty terms published by War Hammer Armaments govern your warranty rights in relation to any product, and Winner Defense Group has no authority to modify or expand those terms.
Summary of War Hammer Armaments Limited Warranty (For Convenience Only)
The following is a general, non-exhaustive summary of typical terms found in War Hammer Armaments warranty materials. In the event of any conflict between this summary and WHA’s own documentation, WHA’s official written warranty controls. You should always consult the latest warranty information provided by WHA for your specific product.
- Coverage & Duration
War Hammer Armaments generally provides a limited warranty to the original purchaser that its products are free from defects in materials and workmanship for a specified period from the date of purchase, which may vary depending on the product line. - Remedy
When a timely and valid warranty claim is accepted, WHA may, in its discretion, repair the product, replace it with the same or a comparable product, or otherwise remedy the issue within a reasonable time after receiving the product and appropriate notice. - Exclusions (Improper Use, Modifications, Ammunition, Wear, Misuse)
WHA’s warranty typically does not cover defects or malfunctions caused by, among other things:- Careless or improper handling, storage, or use;
- Unauthorized adjustments, modifications, or disassembly not performed in accordance with WHA-authorized procedures or by a qualified gunsmith;
- Use of defective, substandard, or improper ammunition;
- Corrosion, neglect, lack of maintenance, ordinary wear and tear, or unreasonable use;
- Criminal misuse or use under the influence of drugs or alcohol; or
- Use of the product in a manner inconsistent with WHA’s written instructions or intended purpose.
- Compatibility & Installation Limitations (e.g., Super Safety)
For certain products such as the Super Safety system, WHA places specific compatibility and installation conditions on use. WHA may state that:- The product is intended only for specified firearm platforms and/or specific lowers or trigger housings;
- Use in out-of-spec, 3D-printed, modified, or non-supported receivers is at the user’s risk; and
- The warranty may be void if the product is installed incorrectly, installed in an incompatible platform, or not installed by a competent gunsmith or qualified armorer, where WHA so requires.
- Limitation of Damages (WHA)
WHA’s terms generally limit its responsibility for incidental or consequential damages (such as economic loss, lost profits, or certain types of personal injury or property damage), subject to any limitations imposed by state law. - Requirement to Follow WHA Instructions
Customers are expected to review and comply with all WHA installation and use guidance. Failure to follow WHA’s instructions, safety warnings, or technical specifications may exclude coverage under the WHA warranty.
This summary is provided solely as a convenience. You are responsible for reviewing War Hammer Armaments’ current warranty terms on their website or in their product documentation for the specific product you purchased.
Making a Warranty Claim (War Hammer Armaments)
All warranty claims for products manufactured by War Hammer Armaments must be made directly to War Hammer Armaments, not to Winner Defense Group.
To initiate a claim under the WHA limited warranty, you should contact War Hammer Armaments using the contact information provided in their current warranty terms, on their website, or in their product documentation. Your claim should generally include:
- Your full name and contact information;
- Proof of purchase (such as an order confirmation or receipt);
- The model and, where applicable, serial number of the relevant product;
- A detailed description of the defect or issue; and
- Any relevant photographs or videos.
WHA may require you to ship the product (or, in the case of certain components, the relevant assembly or firearm) to them for inspection. You are responsible for complying with all applicable federal, state, and local laws regarding any shipment of regulated components or firearms to WHA, and it is strongly recommended that you insure any such shipment. WHA’s terms will govern responsibility for loss or damage in transit and for return shipping where a claim is approved.
Winner Defense Group may, as a courtesy, help you gather documentation or direct you to the appropriate WHA contact, but Winner Defense Group has no authority to approve, deny, interpret, or modify any WHA warranty claim or remedy.
LIMITATION OF LIABILITY (WINNER DEFENSE GROUP)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL WINNER DEFENSE GROUP INC, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO ECONOMIC LOSS, LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ALL EVENTS, THE TOTAL AGGREGATE LIABILITY OF WINNER DEFENSE GROUP INC FOR ANY CLAIM ARISING OUT OF OR RELATING TO ANY PRODUCT OR TRANSACTION SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO WINNER DEFENSE GROUP FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply in certain jurisdictions. In such cases, the limitation will apply to the fullest extent permitted by law.
Nothing in this section limits or modifies any limitation of liability or exclusion of damages that War Hammer Armaments itself applies under its own warranty; those limitations are in addition to, and not instead of, the limitations set forth here.
RETURNS & CANCELLATIONS
Order Cancellations Prior to Shipment
Any order cancelled by the customer prior to shipment will be subject to a non-refundable processing fee of five percent (5%) of the total order amount to cover payment processing and administrative costs.
To request cancellation of an order that has not yet shipped, please email info@winnerdefense.com and include your order number, full name, and the email address used for the order. Orders that have already been shipped cannot be cancelled and will instead be handled under the returns policy below, if applicable.
Return Authorization (RMA) & Time Limits
Arrangements for a return must be made within ten (10) days of the date the order is shown as delivered by the carrier’s tracking information. To request a return, you must contact info@winnerdefense.com and obtain a Return Merchandise Authorization (“RMA”) number before sending any product back.
- RMA numbers are valid for five (5) days from the date of issue.
- All packages received without a valid RMA number clearly marked on the outside of the package may be refused or subject to a restocking fee of up to fifty percent (50%) of the product value, with a minimum restocking fee of ten dollars ($10).
Condition of Returned Items
Returned items must be in new, unused, uninstalled, and resalable condition, in the original packaging with all included components, accessories, manuals, and documentation. We reserve the right to deny or reduce credit for any item that, in our sole discretion, shows signs of installation, use, modification, damage, or abuse.
Restocking Fees & Shipping Costs
- Returned items that are not defective and that are accepted for return will be subject to a restocking fee of up to twenty-five percent (25%) of the product value, with a minimum of ten dollars ($10).
- Original shipping charges and payment processing fees are non-refundable.
- Return shipping costs for non-defective items are your sole responsibility.
If We Are at Fault
If we shipped the wrong item, or the item arrives damaged or defective due to our error, contact us immediately at info@winnerdefense.com. If we determine that Winner Defense Group Inc is at fault, we will provide a prepaid return shipping label and, at our option, either:
- Replace the product; or
- Issue a refund of the purchase price, including standard shipping costs.
We may require photographs or other documentation before issuing a label or authorizing a replacement.
SPECIAL ORDERS & PRE-SALE ORDERS
All special orders and pre-sale orders must be paid in full at the time of sale. Because these products are sourced or configured specifically for you, there are NO REFUNDS on special orders or pre-sale items except as required by law or expressly agreed by Winner Defense Group Inc in writing.
Pre-sale products are given an approximate date of arrival based on information provided by our distributors or manufacturers. These dates are estimates only and are subject to change. Delays in arrival do not entitle you to cancel a pre-sale or special order without our written consent.
UNDELIVERABLE PACKAGES & REJECTED SHIPMENTS
Undeliverable Packages
Occasionally, packages are returned to us as undeliverable due to an incorrect address, inability to obtain a signature, refusal by the recipient, or other carrier issues. When an undeliverable package is returned to us, we will make reasonable efforts to contact you.
- If we are unable to contact you within a reasonable period, we may treat the order as returned and refund the product price minus any applicable restocking fees and shipping costs.
- If you prefer to have the order re-shipped, you will be responsible for any additional shipping charges. In some cases, we may require a confirmed corrected address or signature arrangements before reshipment.
Rejecting Receipt
Rejecting or refusing receipt of a package, or failing to make necessary arrangements with the carrier (such as providing a signature), is considered a return without prior authorization.
- Packages returned to us under these circumstances may be subject to a restocking fee of up to twenty-five percent (25%) of the product value, with a minimum of ten dollars ($10), plus any shipping and carrier-imposed return fees, which may be deducted from any applicable refund.
Re-Shipping
Unless alternative arrangements are made in advance and confirmed in writing, orders that are returned to us will be treated as returned merchandise and restocked. They will not automatically be re-shipped.
If you still want the items after they are returned to us, you must place a new order subject to current pricing, availability, and shipping terms.
MISSING PACKAGES
Occasionally, packages are not delivered in the expected time frame and cannot be located by tracking information. USPS and other shipping providers typically require a waiting period (often up to thirty (30) days) before a package may be considered lost.
If your package appears to be late or missing:
- Verify the shipping address and check with household members or neighbors.
- Check any notices left by the carrier and contact the carrier directly for more information.
- If the package still cannot be located after following the carrier’s procedures and the applicable waiting period has passed, contact us at info@winnerdefense.com.
If a package is confirmed lost pursuant to the carrier’s policies, Winner Defense Group Inc will, at our option:
- Replace the original product ordered, subject to availability and adherence to the carrier’s lost-package policy and claim payout; or
- Issue a refund of the purchase price, less any non-recoverable shipping or insurance costs.
Refunds or returns are only available for orders that have been successfully received or confirmed as lost pursuant to the carrier’s policies. We are not responsible for packages after delivery is confirmed by the carrier (for example, theft from a porch), but we will provide documentation to assist you in any claim you wish to pursue with the carrier, your insurer, or local authorities.
COUPON CODES & DISCOUNTS
Unless explicitly stated in writing by Winner Defense Group Inc, any coupon codes or promotional discounts provided to customers apply to product prices only and do NOT apply to taxes, shipping, insurance, or other fees.
GOVERNING LAW
This policy, and any dispute, claim, or controversy relating in any way to your purchase or use of any Winner Defense Group Inc product, shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to its conflict of laws principles.
Any legal action or proceeding arising out of or relating to this policy or your use of our products shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you hereby consent to the personal jurisdiction and venue of such courts.
By placing an order with Winner Defense Group Inc, you acknowledge that you have read, understood, and agree to be bound by this Shipping, Returns & Warranty Policy.
