These Terms & Conditions (“Terms”) are set forth, maintained, and enforced by Winner Defense Group Inc (“Winner Defense Group,” “we,” “our,” or “us”). By accessing or using this website, placing an order, or purchasing any product from Winner Defense Group, you (“you,” “your,” or “Customer”) agree to be bound by these Terms.

If you do not agree to these Terms, you must not use this site or purchase any products from Winner Defense Group.

1. NATURE OF PRODUCTS – NO FIREARM OR NIGHT VISION SALES

Winner Defense Group Inc is a Texas-based retailer and distributor of firearm parts, accessories, and related equipment.

• We DO NOT sell complete firearms, frames, receivers, or any other serialized items that are regulated as “firearms” under federal law.
• We DO NOT sell night vision devices, night vision optics, thermal imaging devices, or other controlled optical systems.
• We DO sell non-serialized components and accessories, including but not limited to Super Safety component systems and other parts manufactured by War Hammer Armaments.

Nothing on this website, in these Terms, or in any communications from Winner Defense Group Inc should be interpreted as an offer to sell a firearm or night vision device.

You are solely responsible for ensuring that any parts or accessories purchased from Winner Defense Group are compatible with your existing firearms and are used in full compliance with all applicable laws, regulations, and manufacturer instructions.

2. ACCEPTANCE OF TERMS & ORDER ACCEPTANCE POLICY

Your use of this site and/or placement of an order constitutes your acceptance of these Terms, including our Shipping, Returns & Warranty Policy (incorporated herein by reference).

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Winner Defense Group reserves the right at any time after receiving your order to:

• Accept or decline your order for any reason;
• Request additional information to verify your identity, payment method, or compliance with applicable laws; and/or
• Supply an order in an amount less than the quantity you ordered.

We may cancel or refuse any order at our sole discretion, with or without cause. If your order or any part of it is cancelled after payment is processed, we will issue a refund for the cancelled portion, subject to any applicable processing or restocking fees set forth in these Terms or in our policies.

3. CUSTOMER RESPONSIBILITY FOR LEGAL COMPLIANCE

You are solely responsible for knowing, understanding, and complying with all federal, state, and local laws, regulations, and ordinances that apply to:

• The purchase and possession of any parts or accessories;
• The installation and use of any products (including Super Safety component systems); and
• Any modifications made to your firearms or equipment using our products.

By placing an order, you represent and warrant that:

1. You are legally permitted to purchase and possess the items in your jurisdiction;
2. You are not prohibited under any federal, state, or local law from owning or possessing firearm parts or accessories; and
3. You will use all products in accordance with applicable law, safe handling practices, and all manufacturer instructions.

Winner Defense Group may refuse, cancel, or modify any order that we believe, in our sole discretion, may violate applicable law or our internal risk and compliance policies.

4. COPYRIGHT & TRADEMARK NOTICE

Unless otherwise specified, all materials appearing on this site—including text, site design, logos, graphics, icons, images, and the selection, assembly, and arrangement thereof—are the sole property of Winner Defense Group Inc, All Rights Reserved.

You may use the content of this site only for:

• Browsing;
• Shopping in this store; and
• Placing an order.

No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without our prior written permission.

Incorrect or unverifiable information may delay processing or result in cancellation of your order.

7. MULTIPLE PRODUCT ORDERS & OUT-OF-STOCK PRODUCTS

For multiple product orders, we will make every reasonable effort to ship all items in that order at the same time. Products that are unavailable at the time of shipping may be shipped as they become available unless we inform you otherwise.

You will be charged for products contained in each shipment plus applicable shipping charges. Shipping will be charged at the rate quoted at the time of purchase, and the full shipping charge is normally applied to the first product(s) shipped on a multiple-shipment order.

If a product you ordered is out of stock, we will notify you and either:

• Ship the product when it becomes available;
• Offer a substitution (if available and acceptable to you); or
• Cancel the product and issue a refund for that item.

You may cancel an order prior to shipment, subject to any processing fee disclosed in our Shipping, Returns & Warranty Policy or at checkout.

9. TAXES

Our store will automatically calculate and charge applicable sales tax for orders delivered to jurisdictions where Winner Defense Group Inc has a legal obligation to collect such tax.

For orders shipped to other areas, you are solely responsible for any sales, use, VAT, or other taxes that may apply. You agree to indemnify and hold Winner Defense Group harmless from any claims, penalties, or liabilities arising from your failure to pay required taxes.

10. TYPOGRAPHICAL ERRORS, PRICING & PRODUCT DESCRIPTIONS

In the event a product is listed at an incorrect price or with incorrect information due to a typographical error, data error, or an error in pricing or product information received from our suppliers, Winner Defense Group has the right to:

• Refuse or cancel any orders placed for products listed at the incorrect price; and/or
• Refuse or cancel such orders whether or not the order has been confirmed and your credit card charged.

If your credit card has already been charged for the purchase and your order is cancelled, Winner Defense Group will issue a refund to your card in the amount of the incorrect price charged.

We make reasonable efforts to ensure that product descriptions and specifications are accurate. However, errors, omissions, or changes in manufacturer specifications can occur. Product images are illustrative and may differ from the actual product. Your sole remedy for an inaccurate description is to return the item in accordance with our Shipping, Returns & Warranty Policy.

11. PRODUCTS MANUFACTURED BY WAR HAMMER ARMAMENTS & SUPER SAFETY COMPONENT SYSTEMS

All products sold by Winner Defense Group are manufactured by third parties, including War Hammer Armaments, and are subject to those manufacturers’ warranties and limitations.

11.1 No Independent Winner Defense Group Warranty

Winner Defense Group:

• Does not design or manufacture products;
• Provides no independent warranty beyond any limited warranty offered by the manufacturer (e.g., War Hammer Armaments); and
• Sells all products “as is” and “with all faults”, subject only to the manufacturer’s written limited warranty where applicable.

To the fullest extent permitted by law, Winner Defense Group disclaims all implied warranties, including implied warranties of merchantability and fitness for a particular purpose. Where such implied warranties cannot be fully disclaimed under applicable law, their duration is limited to the duration of the applicable manufacturer’s limited warranty.

11.2 Super Safety Component Systems – Compatibility & Use

Super Safety component systems and related parts:

• Are precision components intended for use only in specified and compatible platforms (e.g., certain MP5-pattern or AR-platform lowers and trigger housings);
• Must be installed and tuned by a qualified gunsmith or armorer familiar with the platform and the specific Super Safety system; and
• May be unsafe or non-functional if used in out-of-spec, 3D-printed, modified, worn, or incompatible receivers or housings.

Any use of Super Safety or other components:

• Outside manufacturer specifications;
• In incompatible platforms;
• With substandard ammunition; or
• In violation of manufacturer instructions or local law

is at your sole risk and may void any applicable manufacturer warranty.

Winner Defense Group is not responsible for:

• Improper installation;
• Unsafe or negligent use;
• Modifications to firearms performed by you or any third party; or
• Any resulting injury, damage, or legal consequences.

12. GENERAL WARRANTY DISCLAIMER

EXCEPT FOR ANY LIMITED WARRANTIES EXPRESSLY PROVIDED BY THE PRODUCT MANUFACTURER (SUCH AS WAR HAMMER ARMAMENTS), ALL PRODUCTS SOLD BY WINNER DEFENSE GROUP ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.”

WINNER DEFENSE GROUP INC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, RELATING TO ANY PRODUCT, SERVICE, OR USE OF THIS WEBSITE, INCLUDING BUT NOT LIMITED TO ANY:

• IMPLIED WARRANTY OF MERCHANTABILITY;
• IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE;
• WARRANTY ARISING FROM COURSE OF PERFORMANCE, COURSE OF DEALING, OR USAGE OF TRADE; OR
• WARRANTY OF NON-INFRINGEMENT.

YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE SUITABILITY OF ANY PRODUCT FOR YOUR INTENDED USE.

13. LIMITATION OF LIABILITY

• LOSS OF PROFITS, REVENUE, BUSINESS, OR DATA;
• PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE; OR
• COSTS OF SUBSTITUTE GOODS OR SERVICES,

WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL EVENTS, THE TOTAL AGGREGATE LIABILITY OF WINNER DEFENSE GROUP INC FOR ANY CLAIM ARISING OUT OF OR RELATING TO ANY PRODUCT, TRANSACTION, OR USE OF THIS WEBSITE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO WINNER DEFENSE GROUP FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such cases, the limitations will apply to the fullest extent permitted by law.

• Your violation of these Terms or any applicable law or regulation;
• Your modification or alteration of any firearm, receiver, or component using products purchased from Winner Defense Group; or
• Any use of products by a third party to whom you provide or transfer such products.

15. GOVERNING LAW, JURISDICTION & VENUE

These Terms and any dispute, claim, or controversy arising out of or relating to:

• Your use of this website;
• Any purchase from Winner Defense Group; or
• Any product sold by Winner Defense Group,

shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

16. CHANGES TO TERMS & SITE

Winner Defense Group reserves the right to change these Terms, our policies, and the content of this site at any time, in our sole discretion.

• Changes will be effective when posted on this site with an updated “Last Updated” date.
• Your continued use of the site or purchase of products after any changes constitutes your acceptance of the revised Terms.

17. ENTIRE AGREEMENT & SEVERABILITY

These Terms, together with any policies expressly incorporated by reference (including our Shipping, Returns & Warranty Policy), constitute the entire agreement between you and Winner Defense Group Inc regarding your use of this website and your purchase of products.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
